Anti-Fraud Policy

This Policy ("Anti-Fraud Policy") is made between PT. Meluna Media Kreativitas Indonesia, a company registered in South Jakarta, Indonesia (hereinafter referred to as "Meluna"), and between those who use the Service as Individuals / Legal Entities (hereinafter referred to as "Users"). This Anti-Fraud Policy shall take effect on the effective date in accordance with the User's use of the Service.

Meluna and the User are each a “Part” of this Anti-Fraud Policy and are jointly referred to as the “Parties” who agree to this Anti-Fraud Policy.

WHEREAS, Meluna wishes to ensure the integrity of its services and protect its intellectual property rights; and

WHEREAS, the User agrees to use the services in accordance with applicable terms and not to commit violations or fraud in any form; and

FURTHERMORE, the Parties agree to this Anti-Fraud Policy, which shall be governed by the following provisions:

1. Violation Review and Investigation

Meluna will conduct reviews and investigations of violation reports or suspected fraud involving User accounts. If a violation is proven, Meluna has the right to take action in accordance with this policy. Actions may include warnings, restrictions, or account termination.

Steps that may be taken in a violation investigation include:

  • Delivering notification to the User within 3 business days after the violation is discovered or reported.
  • Examining intellectual property rights violations, artificial streaming, Digital Streaming Platform (DSP) Policy violations, and YouTube Monetization Policy violations.

2. Meluna's Warning System

Meluna will provide up to 2 warnings to Users before considering closing their accounts — except in cases of severe violations that significantly affect Meluna's business. In such cases, the User's account may be terminated immediately.

The first warning will be given in cases of repeated violations that occur within 60 days from the first report received by the User.

The second warning will be given if the same violation continues to recur within a 60-day period from when the first warning was given.

3. Review for Account Closure

After the second warning, Meluna will discuss with the User regarding actions that can be taken to avoid account closure. However, Meluna has the right to determine the time to revoke the User's access from the DSP platform and close the account if deemed necessary.

4. Consequences of Fraudulent Activity

If Meluna considers that the User or their end users have violated the Terms of Service, Meluna has the right to:

  • Remove User content from the platform.
  • Withhold royalties and place them in escrow.
  • Disable distribution to certain DSPs.
  • Terminate the User's account.

Legal fees or other costs incurred by Meluna may be deducted from upcoming payments to the User. Additional legal action may also be taken if losses exceed the amount of royalties withheld.

5. Account Blocking Policy

If the User fails to provide the requested information within 5 business days, Meluna may block the User's account and withhold royalties for 24 months. Users with blocked accounts will not be able to access Meluna's services, and all User content will be taken down.

Withheld royalties (escrow) will apply for:

  • 24 months or until a claim is received.
  • DSPs have the right to request a refund of royalties if deemed to have been obtained through fraudulent activity.

6. Restoration of Blocked Accounts

If the User's account is blocked, the User may apply for access restoration by providing the requested information within 5 business days. Meluna will verify the information provided before reopening account access.

7. Reporting Fraudulent Activity

If you wish to report fraudulent activity or copyright infringement, please send an email to [email protected]. Meluna will investigate the report and take necessary action in accordance with this policy. We take fraud reports and legal violations very seriously.
